FBI and EPA agents served a federal search warrant at GKN Aerospace’s Garden Grove, California facility on the morning of June 10, roughly three weeks after an overheating methyl methacrylate tank forced more than 50,000 Orange County residents from their homes. The warrant, signed by a federal judge, authorizes the seizure of documents and records related to the storage, use, and disposal of MMA at the site. The Orange County District Attorney is running a separate investigation.
The investigation centers on Title 42, United States Code, Section 7412(r), the Clean Air Act’s general duty clause. That provision requires facilities handling extremely hazardous substances to identify hazards, design and maintain a safe facility, and minimize the consequences of accidental releases. It applies regardless of whether a facility falls under a formal Risk Management Program, and it carries criminal liability when prosecutors believe the duty was knowingly neglected.
What Investigators Are Authorized to Take
The seizure list in the warrant is worth reading closely because it describes the paper trail every chemical-handling facility generates. Agents are authorized to collect chemical samples, employee training logs, internal safety complaints, company communications, and documents concerning the storage tanks, cooling equipment, and temperature regulation devices connected to the incident.
The May emergency began with a faulty valve in the tank’s refrigeration system, which normally held the MMA at 50 degrees Fahrenheit. When the contents warmed past their inhibitor threshold, the tank began off-gassing and bulging, and the response escalated to a state of emergency declaration, a nine-square-mile evacuation zone, and a multi-day standoff with a possible runaway polymerization.
Maintenance records on that valve, internal communications about cooling system performance, and any safety complaints filed before May 21 are now federal evidence. The documentation a facility keeps in ordinary operation becomes the record by which its conduct is judged after an incident.
The Chemical Is Still in the Tank
Three weeks after the evacuation lifted, the neutralized MMA remains in the storage tanks. The Orange County Health Care Agency planned to pump the material into sealed trucks for transport and disposal starting the week of June 1, but the removal stalled because the specialized transport resources were not available.
That delay deserves attention from anyone responsible for an industrial facility. Disposal capacity for compromised chemical inventories is not something a facility can summon on demand. Sealed transport, a permitted treatment and disposal pathway, and manifest documentation all have to be lined up, and after a high-profile incident every agency involved reviews each step. A facility that already holds a service relationship with a permitted hazardous waste contractor enters that process with the transport, disposal pathway, and paperwork already established.
Three Investigations and an Unfinished Cleanup
The Garden Grove incident has now produced a mandatory evacuation, a state of emergency, an FBI criminal investigation, a District Attorney investigation, and a disposal operation that is still unfinished a month after the valve failed. Each stage has drawn on records the facility created long before anything went wrong.
Operators handling reactive or temperature-sensitive chemicals should treat this case as the template for how a release gets scrutinized. Keep maintenance logs on safety-critical equipment current and retrievable, document the resolution of internal safety complaints, and confirm that your emergency response plan names a permitted contractor who can handle both the response and the disposal that follows it.
